1. Agreement to Terms

These Terms and Conditions ("Terms" or "EULA") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and TechFlyer ("we," "our," "us," or "Company"), concerning your access to and use of the Calculator Bit iOS and iPadOS application distributed via the Apple App Store (the "Application").

By downloading, installing, accessing, or using the Application, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Application and must discontinue use immediately.

2. License Grant

We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the Application on iOS and iPadOS devices (including iPhone and iPad) owned or controlled by you, and to access and use the Application on such devices strictly in accordance with the terms and conditions of this license and the Usage Rules set forth in the Apple Media Services Terms and Conditions.

You shall not:

• Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Application;
• Make any modification, adaptation, improvement, enhancement, translation, or derivative work from the Application;
• Violate any applicable laws, rules, or regulations in connection with your access or use of the Application;
• Remove, alter, or obscure any proprietary notice posted by us;
• Distribute, rent, lease, lend, sell, redistribute, or sublicense the Application to third parties.

3. Application Functionality and Offline Use

Calculator Bit is designed to work completely offline to perform mathematical calculations. It stores user-configured display and calculation settings locally on your iOS or iPadOS device. No network connectivity is required or utilized by the Application for calculations, state management, or diagnostics.

4. Intellectual Property Rights

Unless otherwise indicated, the Application is our proprietary property and all source code, databases, functionality, software, designs, text, photographs, and graphics in the Application (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by TechFlyer, and are protected by copyright and trademark laws.

5. Disclaimer of Warranties

While we make reasonable efforts to maintain the accuracy of the mathematical formulas and engine within the Application, TechFlyer does not warrant, endorse, guarantee, or assume responsibility for the accuracy, completeness, or reliability of any calculations, results, or outputs generated by the Application. You are solely responsible for verifying critical mathematical calculations prior to making financial, professional, or academic decisions based on them.

6. Limitation of Liability

In no event will TechFlyer, its developers, directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Application, even if we have been advised of the possibility of such damages.

7. Apple App Store Legal Provisions

Because you downloaded the Application via the App Store, you acknowledge and agree to the following provisions:

• Acknowledgment of Parties: You acknowledge that these Terms are concluded between you and TechFlyer only, and not with Apple, Inc. ("Apple"). TechFlyer, not Apple, is solely responsible for the licensed Application and the content thereof.
• Maintenance and Support: TechFlyer is solely responsible for providing any maintenance and support services with respect to the Application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
• Warranty: In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
• Product Claims: You acknowledge that TechFlyer, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of that Application.
• Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

8. Modifications to the Application

We reserve the right to change, modify, or remove the contents of the Application or suspend access to parts or all of the Application at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information or provide ongoing support, maintenance, or bug fixes, except as required by Apple App Store policies or applicable law.

9. Term and Termination

These Terms shall remain in full force and effect while you use the Application. We may, at our sole discretion, terminate or suspend your access to the Application at any time, without notice or liability, for any reason. Upon termination of your rights under these Terms, you must cease all use of the Application and delete all copies of the Application from your iOS and iPadOS devices.

10. Governing Law

These Terms and your use of the Application are governed by and construed in accordance with the laws of the jurisdiction where TechFlyer operates, without regard to its conflict of law principles.
